Pa. mun. auth. sues over watershed project

BROCKWAY, Pa.—A north-central Pennsylvania municipal authority has filed a lawsuit over a Marcellus Shale-related project on watershed land.

Environmental attorney Bob Ging filed suit for the Brockway Borough Municipal Authority in Jefferson County against Flatirons Development. Flatirons and the authority had reached agreement for a parcel of the authority's 4,000 acres of watershed land.

The suit says Flatirons plans to build an impoundment and clear-cut 23 acres of timber in preparation for drilling into the natural gas-rich Marcellus Shale on property not covered by the agreement.

The authority wants the court to stop construction, and wants Flatirons to demonstrate the water supply will be protected, citing in part concern about potential pollution.
